WHEELING, W. Va. (CN) - Consolidation Coal Co. claims that despite the death of a worker at Ireland River dock in West Virginia on Dec. 29, 2008, Labor Secretary Hilda Solis and OSHA have no right to impose new safety rules on it.
The coal company sued in Federal Court.
