Detective immune, despite deceit
NEW ORLEANS — The Fifth Circuit reversed a Texas federal court’s decision to deny a Dallas detective his motion to dismiss a lawsuit against him. He’s accused of improperly inserting himself into the criminal investigation of a shooting outside a bar that neighbors the real estate agency where the detective moonlighted, accusing the owner of the bar and a security guard of tampering with evidence without disclosing his conflict of interest to the police department. Regardless of the intent behind his “questionable conduct,” he is owed state-agent immunity from the suit.
