Macabre reason for warranty claim’s failure
JASPER, Ala. — A federal court in Alabama granted summary judgment to American Honda Motor Company on the breach-of-warranty claim brought by the estate of two people who died in a crash on a used 2008 Honda motorcycle. The estate cannot recover damages because all the evidence supports the conclusion that the couple was killed immediately when their bike ran off a road and struck a tree; an Alabama breach-of-warranty claim requires evidence of suffering from an injury between the time of the crash and the time of death.
