No mandamus for Texas AG Paxton

AUSTIN, Texas — An appeals court in Texas denied Attorney General Ken Paxton’s request for mandamus relief after a trial court denied his office’s pre-suit deposition petition against a nonprofit that aids asylum-seekers in the border town of Brownsville. Pre-suit depositions are “not intended as a vehicle to probe facts for the sake of probing” and their results cannot be considered as evidence; if the attorney general has enough evidence to sue the nonprofit, this would undercut the state’s claim that it needs to take the deposition.
