Squishmallows prevail
ST. LOUIS — A federal court in Missouri determined it is not the proper jurisdiction in a trademark dispute between Build-A-Bear Workshop and the maker of Squishmallow plushies, which has sued Build-A-Bear in other jurisdictions over the similarities between Squishmallows and its competitor’s Skoosherz toys. Build-A-Bear seeks a declaratory judgment determining its Skoosherz do not violate the Squishmallow trademarks, but the Squishmallow manufacturer has never sued Build-A-Bear in Missouri, so the court lacks jurisdiction.
